1. General Terms and Conditions
1.1 All contractual dealings between Auston Fox (including its related entities) and any person (the customer) in relation to the purchase of goods will be governed by the terms and conditions supplied by Auston Fox found on www.austonfox.com.au (the website). By using the website and its domain subsidiaries the customer agrees to be legally bound by the terms set out by Auston Fox.
1.2 While these terms are legally binding on all consumer transactions made from the website, Auston Fox reserves the right to modify, add or remove any of the terms set out in this agreement without notice to the customer.
1.3 Auston Fox will comply with the Australian Consumer Law guarantees and nothing in these terms attempts to contract out of guarantees or other applicable laws which cannot be excluded.
1.4 All contractual and commercial laws will be governed by the laws of Queensland, Australia. Any disputes arising out of these terms will be heard within this jurisdiction. Upon the purchase of a good the customer is submitting to the exclusive jurisdiction under the courts of Queensland and other courts entitled to hear appeals from those courts.
2. Terms of Sale
2.1 By entering into a contract for the purchase of goods on the website, the customer is agreeing to purchase said goods in accordance with these terms and relevant Australian Consumer Law provisions. Upon submitting an order the customer is acknowledging that all goods will be used only for personal or domestic use in a non-commercial manner.
2.2 While stock numbers are closely monitored and the website is updated in accordance, all orders are subject to the availability of the goods. While all relevant business is welcomed, Auston Fox reserves the right to refuse an order if Auston Fox sees fit.
2.3 The price of all goods is clearly displayed on the relevant website pages in Australian Dollars (AUD). All prices of goods are exclusive of delivery fees. Delivery fees will be calculated at checkout.
3.1 All deliveries will performed by Australia Post using the delivery method selected by the customer at checkout.
3.2 If the customer elects to provide the delivery service with the authority to leave the goods at an address without a signature, it is suggested by the company that the customer has someone available at that address to retrieve the goods.
3.3 The delivery of the goods signifies the passing of ownership of the goods, therefore Auston Fox accepts no liability for any loss, theft or damage sustained by the goods after the time of delivery. This passing of ownership to the customer also includes the delivery of goods at an unattended address. The act of delivery signifies the transferal of liability, regardless of the type of delivery selected.
4. Exchange and Returns Policy
4.1 Auston Fox accepts exchanges within 14 days of the delivery date. For goods to qualify for exchange they must be unworn and in their original purchase condition with all promotional tags still attached to the goods. To initiate the exchange program the customer is required to contact Auston Fox via email at firstname.lastname@example.org to explain the surrounding circumstances and subsequently receive a return authorisation number.
4.2 If the purpose of exchange is a result of the initial garment purchase being of an incorrect size, Auston Fox will immediately hold the good in the correct size that the customer wishes to exchange for (subject to availability). This hold will be for up to 14 days following the initiation of the exchange process. Once the good from the initial purchase is received by Auston Fox, the good will be inspected and assuming the good is returned in its initial purchase condition the replacement good will be sent back to the customer at Auston Fox’s expense.
4.3 If the customer is returning goods for any other reason than the goods being damaged or faulty, the customer will receive a store credit upon the successful determination that the good was returned in its initial purchase condition.

5. Damaged or Faulty Goods
5.1 While all goods are inspected by Auston Fox prior to postage, if the goods received are damaged or faulty Auston Fox will comply with its obligations under Australian Consumer Law to provide a full monetary refund to the customer.
5.2 If the goods received appear damaged or faulty, the customer must contact Auston Fox within 14 days via email@example.com and notify Auston Fox of the exact issues with the product. Once notified, Auston Fox will direct the customer through the appropriate returns protocol.
5.3 Once Auston Fox receive the goods and confirm the damage or fault, the customer will be entitled to either a full refund (including postage expenses) of the initial purchase price or an exchange for a good that is free from defect (with postage expenses paid by Auston Fox). If the customer requires a refund, Auston Fox will re-credit the customer through the vehicle of purchase for the price of the goods and shipping only within 48 hours following the refund approval. Auston Fox accepts no responsibility for any bank fees incurred for the initial transaction.
